These terms are issued by TopCatch HQ Limited ("TopCatch") and are effective from July 1st 2014. They cover the use of our website www.topcatch.co.nz, as well as any of our sites accessible from this website. Use includes visits to our sites, purchases on our sites, participation in our database and promotions. These terms of use apply to you when you use our websites. Please read these terms carefully - if you need to refer to them again they can be accessed from the link at the bottom of any page of our website.

While we endeavour to supply accurate information on this site, errors and omissions may occur. TopCatch HQ Limited ("TopCatch") does not accept any liability, direct or indirect, for any loss or damage which may directly or indirectly result from any advice, opinion, information, representation or omission whether negligent or otherwise, contained on this site. You are solely responsible for the actions you take in reliance on the content on, or accessed, through this site.

TopCatch reserves the right to make changes to the content on this site at any time and without notice.

To the extent permitted by New Zealand law, TopCatch makes no warranties in relation to the merchantability, fitness for purpose, freedom from computer virus, accuracy or availability of this web site or any other web site.

 

Ording goods and services from us

When you place an order with us, you are making an offer to buy goods or services. An order is placed on our website via adding a product to the shopping cart and proceeding through our checkout process. The checkout process includes giving us delivery and any other relevant details for your order eg. an optional gift message for gift cards, entering payment information and submitting your order. The final step consists of a confirmation page with full details of your order, which you are able to print as a receipt of your order

We reserve the right to limit the number of an item customers can purchase in a single transaction.

We will send you an e-mail to confirm that we have received and accepted your order, which indicates that your order has been accepted and you may not cancel it.

We will take payment from you when we accept your order


Refusing or cancelling orders

In the unlikely event that the goods or services ordered are no longer available we reserve the right to refuse or cancel an order.

We reserve the right to refuse or cancel any orders that we believe, solely by our own judgement, to be placed for commercial purposes, e.g. any kind of reseller. We also reserve the right to refuse or cancel any orders that we believe, solely by our own judgement, to have been placed fraudulently.

While we endeavour to ensure that the price and description of goods or services is accurate, if there is an error in the process of listing a product or service on our website or a technical error in the processing of your order we reserve the right to refuse or cancel the order.

Our right to cancel orders applies to orders that have been accepted.


Payment options

We currently accept the following credit cards:

Visa
MasterCard

Lay-by is available in store only.  The following conditions apply:
- A lay-by administration fee will apply
- Minimum 20% deposit
- Minimum lay-by value $50.00 (can be made up of more than one item)
- Monthly payments required (payments must be made to the store where the original lay-by deposit was recorded)
- Cancellation Fee (we reserve the right to charge a cancellation fee of $10 to cover the cost of storage, processing and any loss in retail value)
- Total lay-by term is 3 months; however this term may be extended to 6 months for high value items at the Store Managers discretion 


Pricing

All prices listed on www.topcatch.co.nz  are in New Zealand dollars and are inclusive of GST.  Please note that we reserve the right to alter prices on our websites at any time for any reason. Online and in store pricing may differ.

For orders shipped to destinations outside New Zealand the price excludes GST, Value Added Tax (VAT) and any other taxes specific to the destination country. Orders to destinations outside New Zealand may be subject to local sales tax and/or import duty and customers remain liable for payment of these taxes or duties on or following delivery.


Finance

Currently TopCatch do not offer finance on online purchases.  We are working on this currently.


Website and Credit Card Security

We want you to have a safe and secure shopping experience online. All payments via our sites are processed using SSL (Secure Socket Layer) protocol, whereby sensitive information is encrypted to protect your privacy.

You can help to protect your details from unauthorised access by logging out each time you finish using the site, particularly if you are doing so from a public or shared computer.

For security purposes certain transactions may require proof of identification.


Delivery and Delivery Period

If you purchase before 2pm on a weekday, we will do our best to get the goods out that day using our courier post 24 hour service.  (South Island and rural addresses can take longer).

Once we have shipped your goods we will send you the courier post tracking details so you can track your parcel online.

Courier Post can ship to PO Boxes so we do encourage this for security where you wont be home.

If there is for any reason a delay in getting your product shipped to you, we will contact you to let you know the situation.

The goods become the recipient’s property and responsibility once they have been delivered to the specified delivery address.  If goods are lost or damaged in transit, please contact us within 7 business days at website@topcatch.co.nz.   We will use this delivery information to make a claim against our courier company. We will offer you the choice of a replacement or a full refund, once we have received confirmation from our courier company that delivery was not successful.


Delivery Charges

Unless TopCatch specifically identifies otherwise, our delivery costs are as follows:

Auckland – shoebox parcel up to 5kg - $5.95

Auckland – over 5kg or over a shoebox size - $9.95

North Island outside Auckland - $9.95

South Island - $14.95 – please note this costs us over $20

Large Bulk items are not covered by our Courier Post service and could involve extra shipping charges.


Returns and Refunds

At TopCatch we offer a Money Back Guarantee for our online purchases.  If you change your mind about a product, or received the wrong product, you can return the product as long as:

  • You do so within 28 days of receiving the product
  • Provide proof of purchase for that product
  • And send it back in an unused condition in its original packaging.

TopCatch can offer you replacement goods or a refund if you wish

Damaged or faulty goods

Consumer Guarantees Act 1993 and Fair Trading Act 1986 – these acts set out the law to protect your rights as a consumer.  TopCatch adhere to good practice as set out by these acts.

When you receive product that is either faulty or damaged, we will at our discretion either;

  • Repair the product
  • Replace them with new product
  • Or in some cases offer a refund

How to return damaged or faulty goods

When you return a product to our dispatch store, it is the consumers cost to return items in all instances.

To make a return, please contact us first at the details listed at the top of this page.  From there we can check our records and give you further instruction.  Please note that all returns must come with their original packaging and you must be able to provide the appropriate proof of purchase.


Gift card usage

Pre paid gift cards are redeemable for goods sold at any TopCatch store in New Zealand. Lost or stolen cards are the responsibility of the holder. Gift cards expire 24 months after the last transaction. 


Accessing our service

Other than connecting to TopCatch website by HTTP requests using a web browser, you may not gain access to TopCatch website servers. You agree not to disrupt, modify or interfere with our websites or services and their associated software, hardware and servers in any way. You also agree not to modify any content or service on TopCatch websites. Furthermore, you agree not to use our sites in any inappropriate or unlawful way.

Our website is intended to provide information for people shopping our products and accessing our services, including making purchases via our website and registering on our database to receive e-mails from us.

At TopCatch, your privacy is extremely important to us.  We treat customer information as strictly confidential and do not share it with any other parties outside of the TopCatch Group.

By signing up as an account member or simply to our newsletter, we  may send you information on products, specials and promotions on a weekly basis.  You may remove your name from our subscription list by using the opt-out function on all newsletters that we send.

As required by the Privacy Act 1993, TopCatch follows strict procedures when storing and using the information you have provided.
